Introduction

The Environmental Impact Assessment (Uncultivated Land and Semi-Natural Areas) (Scotland) Regulations 2002 (S.S.I. 2002 No 6)

The above Regulations came into force in Scotland on 4 February 2002.

In brief, the Regulations constrain operations to carry out 'intensive' agricultural operations on land that is uncultivated or semi-natural where the result would have a 'significant' impact on the environment.

SEERAD act as the competent authority in determining applications. All applications will be processed and the regulations administered by SEERAD local Area and Area Sub Offices. Farmers and other land managers can seek from SEERAD an initial Screening opinion on whether proposals are a 'project' in terms of the Directive.

If concerns arise over the impact of the 'project', an environmental assessment will be required which is made available for public inspection as well as seeking the opinion of statutory (and other appropriate) consultees. Notification of decisions will be given in local newspapers.
