3. ANALYSIS OF RESPONSES

There are a number of main themes included in the consultation, and generally the specific consultation questions correlate well to these themes.

The main themes covered in the consultation, and forming the structure of this report, are:

  • Sustainable flood management - the concept as it is defined in the consultation, the clarity of the definition and the applicability of the principles;
  • Flood Risk Management - dealing with the identification of a competent authority for the purposes of the Floods Directive, and developing a structure for national and local flood risk management plans;
  • Statutory Processes- dealing with the planning implications of new flood management measures, and the role of local authorities and Scottish Ministers in granting consent;
  • Reservoir safety - dealing with the proposal to introduce a transfer of responsibility for enforcement of the Reservoirs Act 1975 in Scotland from local authorities to a single enforcement authority.
